Post Event Update | Hogan Lovells Foreign Investment Regulations Update

AustCham Beijing would like to thank the speakers, Mr. Roy Zou, Sherry Gong and Ms. Lu Zhou from Hogan Lovells. All three speakers gave detailed insights into the new NPC Decision and Record Filing updates and highlighted the importance of the new negative list administration model, which only requires FIE’s in the most sensitive sectors to receive approval for FDI. They elaborated on the updated record filing procedures, which can now be done online to streamline the process. The panel also mentioned that there is a need for a single nationwide Negative List to improve the efficiency and identify what projects fall into Restricted and Prohibited sectors. The panel concluded highlighting that the NPC Decision and Interim Measures will have an overall positive impact on FDI regulation.

Mr. Roy Zou
Partner, Beijing
Roy Zou works with companies on merger and acquisition transactions, the creation of joint ventures, market entry, and international trade. He has extensive experience in directing legal and financial due diligence reviews of Chinese companies for multinational corporations and investors. Over the decades, Roy regularly dealt with approval authorities and other government regulators and agencies in connection with commercial transactions. Roy ‘s career has spanned corporate, government and regulatory practices.
Roy previously worked at the Ministry of Foreign Affairs of the People’s Republic of China for seven years. Serving in the General Office and the Department of Treaty and Law, he was involved in the documentation and negotiation of many important bilateral and multilateral issues. Roy’s diplomatic career included assignments in overseas Chinese missions. Roy speaks Chinese Mandarin and English.
Sherry Gong
Counsel, Beijing
Sherry Gong’s practice focuses on foreign direct investment, mergers and acquisitions, government regulatory, commercial contracts, privacy and information management, and employment. She advised many multinational companies in cross-border transactions, especially in telecommunications, media, technology, education, life science and energy industries.
She represented more than 50 international educational institutes for their operation and activities in China. She is recognized as a leading lawyer in China higher education area. Sherry is also familiar with the legal needs of our information and technology clients, having advised extensively on a wide-range of matters in this sector including complicated market entry and regulatory issues, and industry-specific licenses.
Ms. Lu Zhou
Counsel, Beijing
Lu Zhou has extensive experience representing clients in complex cross-border transactions, including in-bound and outbound mergers and acquisitions, joint venture, private equity and venture capital matters. Lu also regularly advises clients in their recapitalizations, restructure and spin-offs transactions due to regulatory constraints or for tax efficiency purpose. Lu’s practice covers various industries, including media, technology, telecom, hospitality and life science.
Prior to joining Hogan Lovells International LLP, she worked as an associate at a law firm in New York. She has also worked for The Honorable Michael Davis in the U.S. District Court, District of Minnesota as a judicial extern and clerked for the judges in the Board of Veterans’ Appeals in Washington, D.C.
