On January 4 2010 the State Administration for Industry and Commerce (SAIC) and the Ministry of Public Security issued a notice on Strengthening Administration for Registrations of Foreign Enterprises Resident Representative Institutions (Gong Shang Wai Zi No 4).
Setting up a legally registered entity in China can be a complex and lengthy process, yet establishing a representative office in China is common practice for entities needing presence for marketing and purchasing for export activities purposes - however, are you compliant?

Nicolas has a broad based corporate and M&A practice with a focus on China foreign direct investment (FDI), corporate and commercial and corporate regulatory compliance.
Having worked in China for over 10 years, Nicolas is also experienced in dispute resolution and financing. He has particular expertise in the telecommunications and media, real estate, climate change and clean energy sectors, as well as experience in the areas of labour law, construction, automotive, and financial services industries.
Qualified as a solicitor in England and Wales, he graduated from Cambridge University. He has published several articles in the area of foreign investment in China. He speaks Mandarin fluently, and reads and writes Chinese.
Sara Marchetta, Senior Associate, Chiomenti Studio Legale Beijing Office
In 2002 Sara Marchetta also graduated in Law at the University of Parma and she is currently a member of the Italian Bar Association. From 1997 to 2008 she worked with the Italian law firm Birindelli e Associati, as managing partner of the Beijing office.
Sara Marchetta is now a senior associate of Chiomenti Studio Legale in Beijing, where her practice area is corporate law. She is fluent in English and Chinese mandarin.
